Terms of Service
By using Fact Check (the "Service"), you agree to these Terms of Service ("Terms"). If you don't agree, don't use the Service.
1. What the Service does
Fact Check is an application for Even Realities G2 smart glasses. It buffers the last 30 seconds of audio from the glasses microphone. When you tap, it sends that audio to Google's Gemini 2.5 model and returns a short verdict (TRUE / FALSE / PARTIALLY TRUE / UNCERTAIN / NO CLAIM) along with a one-sentence claim and brief explanation.
2. Fact-check accuracy disclaimer
The Service's verdicts are generated by an AI model and are not authoritative. They may be wrong. Do not rely on Fact Check verdicts for medical, legal, financial, safety-critical, or any other consequential decisions. Always verify important claims through primary sources. We make no warranty as to the accuracy, completeness, or fitness for purpose of any verdict returned by the Service.
3. Eligibility
You must be at least 13 years old (or 16 in the EEA/UK) and have the legal capacity to enter into these Terms. By using the Service you represent that you meet this requirement.
4. Free tier and Pro subscription
- Free tier: up to 2 fact-checks per UTC day per Even Realities account, free of charge.
- Fact Check Pro: unlimited fact-checks, billed at US$2.99 per month (subject to applicable taxes) via Stripe. Subscriptions auto-renew monthly until canceled. The price is a launch promotion and may increase for new subscribers at a future date; existing subscribers will be notified at least 30 days in advance of any price change.
5. Cancellation and refunds
You may cancel your subscription at any time via the Customer Portal accessible from the app. Cancellations take effect at the end of the current billing period; you keep Pro access until that period ends. We do not provide pro-rata refunds for partially-used periods.
If you believe you were charged in error, email [email protected] within 14 days of the charge and we will review your case.
6. Acceptable use
You agree not to:
- Use the Service to record audio of any person without their consent where the law requires it (note: laws vary; some jurisdictions are all-party consent for audio recording).
- Attempt to bypass quota limits by creating multiple accounts, sharing accounts, or other circumvention.
- Reverse-engineer, decompile, or extract the source code of the Service except as permitted by law.
- Use the Service for any illegal purpose or to violate any law.
- Attempt to overload, attack, or disrupt the Service or its infrastructure.
We may suspend or terminate your access for violations of these rules.
7. Privacy
Our handling of information is described in our Privacy Policy, which is incorporated into these Terms by reference.
8. Intellectual property
The Service, its source code, and its trademarks are owned by us (or our licensors). You receive a limited, non-exclusive, non-transferable license to use the Service for personal use. You retain ownership of any audio you record.
9. Third-party services
The Service depends on Google Gemini, Stripe, Supabase, Cloudflare, and Even Realities (see the Privacy Policy). Your use of the Service is also subject to those providers' terms. We are not responsible for outages or changes caused by those providers.
10. Limitation of liability
To the maximum extent permitted by law, in no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data, arising out of or in connection with your use of the Service. Our total cumulative liability to you in any 12-month period is capped at the amount you paid us in that period (so US$0 if you only used the free tier).
11. Warranty disclaimer
The Service is provided "AS IS" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
12. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, your access ceases and any unpaid amounts become immediately due.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced via the app and the Even Hub listing at least 30 days before taking effect. Continued use after a change constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. Disputes shall be resolved in the courts located in Montreal, Quebec, unless mandatory consumer-protection law of your jurisdiction provides otherwise.
